DINR App Privacy Policy

Please read the following DINR Privacy Policy (“Policy”) to understand how your personally identifiable information (described herein) and data is collected, used and disclosed by DINR. By submitting your personally identifiable information to us, by registering for or using any of the services we offer, or by voluntarily interacting with us, you consent to our collecting, using and disclosing your personally identifiable information as set out in this Policy, as revised from time to time.
In this Policy, DINR shall refer to its subsidiaries, affiliates, and any of their respective employees, agents, merchants, partners, third-party content providers or licensors, or any of their officers, directors, employees or agents.
This Policy applies to DINR’s mobile applications, websites, emails and social media accounts ("Applications") and the booking of restaurant availabilities and other services (collectively, "Services") available through the Applications. When you use the Applications and our Services, you accept the practices detailed herein and agree to the terms of this Policy.
We reserve the right to change the details and provisions of this Policy at any time. However, you will know that changes have been made because we shall indicate, at the outset of this Policy, the date it was last revised and updated. We therefore encourage you to regularly review this Policy in order to ensure that you understand how any personally identifiable information you provide us or collected about you will be used.

1. What is personal identifiable information?
As used throughout this Policy, the term "Personally Identifiable Information" means information that specifically identifies you as an individual (such as, your name, user or account name, email address and phone number), or information about that individual that is directly linked to information that specifically identifies an individual. This type of information is required in order for you to fully benefit from our Services and for us to manage your account and to provide you with access to said Services.
Personally Identifiable Information does not include aggregate or anonymized information, which is data we collect in connection with the use of the Services or about a group or category of services or users, from which individual identities or other Personally Identifiable Information has been removed. This Policy in no way restricts or limits our collection and use of aggregate information.
2. Your Consent to Collection, Use and Disclosure
We collect, use and disclose your Personally Identifiable Information with your consent or as permitted or required by applicable privacy laws. How we obtain your consent (i.e., the form we use) will depend on the circumstances, as well as the sensitivity of the information collected. Subject to applicable laws, your consent may be express or implied, depending on the circumstances and the sensitivity of the Personally Identifiable Information in question.
If you choose to provide Personally Identifiable Information to us, we assume that you consent to the collection, use and disclosure of that Personally Identifiable Information as outlined in this Policy.
If you wish to withdraw your consent to our collection, use or disclosure of your Personally Identifiable Information, please contact us using the contact information in the “Still Have Questions” section below. However, before we implement the withdrawal of consent, we may require proof of your identity. In some cases, withdrawal of your consent may mean that we will no longer be able to provide certain products or services.
If you provide Personally Identifiable Information about another individual to us, it is your responsibility to obtain the consent of that individual to enable us to collect, use and disclose his or her information as described in this Policy.
3. What type of information does DINR collect?
Active Collection – We collect information from you in various ways when you use the Applications and Services, such as information:
(i) that is provided to us (such as your name, email address, telephone number, credit card number, expiration date, authentication code, or similar information);
(ii) to which you provide us access;
(iii) about you that is publicly available; and
(iv) received by us about you from third-party sources.
You can choose not to provide certain Personally Identifiable Information but, if you choose to do so, you may not be able to access or use the Services.
Passive Collection – When you use the Services, some information is also automatically collected, such as your Internet Protocol (IP) address, your operating system, the browser type, the address of a referring website, and your activity while using the Services. We may also automatically collect certain logistical information in server logs, including information about how you use various features of the Services and information about the number, frequency and length of each session.
Collection through Other Interactions – For individuals who otherwise interact with us, whether in person, by phone or email, through social media or otherwise, including individuals who might be interested in acquiring our products or services, who sign-up to receive newsletters or other communications, or who respond to surveys and questionnaires, we may collect information that you provide to us during these interactions. This information may include (without limitation) your name, e-mail address and other contact information.
We may also automatically collect certain information through the use of "cookies". Cookies are small data files stored on your hard drive at the request of a website. Among other things, cookies help us to improve the Services and your overall experience of the Applications. If we link cookies to any Personally Identifiable Information, we will treat this information as Personally Identifiable Information. If you wish to block, erase, or be warned of cookies, please refer to your browser manufacturer to learn about these functions. However, if you choose to remove or reject cookies, this could affect certain features or services made available via the Services.
We may also employ the use of anonymous identifiers, which are random strings of characters that are used for the same purposes as cookies on platforms, including certain mobile devices, where cookie technology is not available.
We may use Web beacons or similar technology with the Services. Web beacons are small, invisible graphic images that may be used on the Services or in emails relating to the Services to collect certain information and monitor user activity on the Services, such as to count visits, understand usage effectiveness and to tell if an email has been opened and acted upon.
We may collect device-specific information (such as your hardware model, operating system version, unique device identifiers, and mobile network information). We may associate your device identifiers or phone number with your DINR account.
4. How do we use the personally identifiable information we collect?
We use Personally Identifiable Information collected through the Applications and Services for the purposes described in this Policy. For example, we may collect said information for the following reasons:
to process and complete any restaurant availability or booking in connection with the Services;
to request feedback and to otherwise contact you about your use of the Applications or Services;
to collect opinions and comments about our products and services (where we have your consent to);
to respond to your emails, questions, comments, requests and complaints, and to provide you with better overall customer service;
to monitor and analyze the usage and trends of the Services;
to generate de-identified and aggregated data to conduct research and analysis related to our business, products and services;
to personalize and improve the Services, and our users' experiences with the Services (such as providing content or features that match interests), and to increase the Services' functionality and user friendliness;
to provide you with news and information about our or third-party events, offers, promotions and services we think will be of interest to you (where we have consent to);
to send you booking confirmations, updates, security alerts and support and administrative messages, and otherwise facilitate your use of, and our administration and operation of the Services;
to notify you about important changes to the Services; and
for any other purpose for which the information was collected.
Use of personally identifiable information and non-personally identifiable information such as information that is passively collected helps us create and improve a more user-friendly experience for all of our Applications users by allowing us to measure and improve our understanding of user traffic and behavior, while also providing us with a means of measuring our performance and the success of our Services and Applications.
We do not, under any circumstance, sell or rent any Personally Identifiable Information and we do not share information without your prior consent, except when compelled by law or a governmental authority. We may, however, share with certain third parties aggregated or anonymized information in a form that does not directly identify you as an individual.
Finally, in exceptional circumstances, DINR may access and disclose your Personally Identifiable Information to troubleshoot, to resolve disputes, to accomplish administrative tasks that we deem necessary to maintain, for customer service, and to improve our Services, as well as in connection with or during the negotiation of any merger, sale of company assets, financing or acquisition of all or a portion of our business to another company, to contact you, and to enforce our agreements with you, including our Terms of Service and this Policy, both of which comply with applicable law and when necessary to comply with laws or to respond to lawful requests and legal process or in case of an emergency to protect the personal safety of DINR or any person.
We may also disclose your Personally Identifiable Information to identify, contact or bring legal action against someone who may be violating the rights and property of DINR, our agents, customers, users, and others including to enforce our agreements, Terms of Service and this Policy.
5. What personally identifiable information do we share with third parties?
We will not knowingly share the Personally Identifiable Information we collect from you through the Services with third parties, except as described in this Policy or with the Terms of Services. For example, we may share Personally Identifiable Information in the following circumstances:
with vendors, consultants, and others who are engaged by or working with us in connection with the operation of the Services and who require access to such information to carry out their work for us;
with restaurants that you have reserved a booking through the Applications and Services;
when you give us your consent to do so, including if we notify you via the Applications or Services that the information you provide will be shared in a particular manner and you provide such information;
in an aggregated or anonymized form that does not directly identify you as an individual;
when we believe in good faith that we are lawfully authorized or required to do so or that doing so is reasonably necessary or appropriate to comply with the law or legal processes or to respond to lawful requests or legal authorities including, but not limited to, responding to lawful subpoenas, warrants, or court orders;
when we believe in good faith that we are lawfully authorized or required to do so or that doing so is reasonably necessary or appropriate to protect the rights, property, or safety of DINR, our users, our employees, copyright owners, third-parties or the public including, but not limited to, protecting DINR or our users from fraudulent, abusive, inappropriate, or unlawful use of the Services;
to enforce or apply this Policy, the terms herein, or our other policies or agreements; and
in connection with, or during negotiations of, any merger, sale of company assets, financing or acquisition, or in any other situation where personally identifiable information may be disclosed or transferred as one of the business assets of DINR.
You understand that when you use the Services, information you provide via the Applications and Services, information you grant access to by using the Services, as well as any information you share with individuals through the Applications or Services, may, in some cases, become publicly available on the Applications (with the exception of Personally Identifiable Information, which shall not become publicly available, unless such Personally Identifiable Information is shared by you as part of a review, photo submission or other similar method).
We are not responsible for the actions of your mobile service providers or other third-parties, nor are we responsible for any additional information you provide directly to any other users or third-parties, and we encourage you to become familiar with all respective third-party privacy practices before disclosing information directly to any such third-parties. Nothing herein restricts the sharing of aggregated or anonymized information, which may be shared with third parties without your consent.
6. Third Party Websites and Services
This Policy does not extend to any websites or products or services provided by third parties. We do not assume responsibility for the privacy practices of such third parties, and we encourage you to review all third party privacy policies prior to using third party websites or products or services.
7. Opting In and Out of Marketing-Related Communications
You must opt-in in order to receive marketing-related emails from us. If you no longer want to receive marketing-related emails from us, you may opt-out of receiving marketing-related emails by clicking the “unsubscribe” link at the bottom of any email you receive from us. You may also opt-out by contacting us directly using the contact information in the “Still have questions?” section below.
We will endeavour to respond to your opt-out request promptly, but we ask that you please allow us a reasonable time to process your request. Please note that if you opt-out from receiving marketing-related emails, we may still need to send you communications about your use of our products or services, or other matters.
8. How long do we retain your Personally Identifiable Information?
We will use, disclose or retain your Personally Identifiable Information only for as long as necessary to fulfill the purposes for which that Personally Identifiable Information was collected and as permitted or required by applicable privacy laws.
9. What steps do we take to protect your information online?
We take measures to protect your Personally Identifiable Information in an effort to prevent loss, misuse, and unauthorized access, disclosure, alteration, and destruction. Please be aware, however, that despite our best efforts, no security measures are perfect or impenetrable, and no method of data transmission can guarantee against any interception or any other type of misuse. To assist with the protection of Personally Identifiable Information, you must keep your password confidential and not disclose it to any other person. You are responsible for all uses of the Applications and Services by any person using your account and password. 10. International Transfer and Storage of Information
Your Personally Identifiable Information may be stored and processed at our offices in Canada or at the offices of our third party service providers in Canada and the United States. Other jurisdictions may have different data protection rules than Canada. While your Personally Identifiable Information is outside of Canada, it is subject to the laws of the country in which it is located. Those laws may require disclosure of your Personally Identifiable Information to authorities in that country. 11. Accessing and Updating Your Personally Identifiable Information
We expect you, from time to time, to supply us with updates to your Personally Identifiable Information, when required. We will not routinely update your Personally Identifiable Information, unless such a process is necessary.
You may make a written request to review any Personally Identifiable Information about you that we have collected, used or disclosed, and we will provide you with any such Personally Identifiable Information to the extent required by applicable laws. You may also challenge the accuracy or completeness of your Personally Identifiable Information in our records. If you successfully demonstrate that your Personally Identifiable Information in our records is inaccurate or incomplete, we will amend the Personally Identifiable Information as required.
We may require that you provide sufficient identification to fulfill your request to access or correct your Personally Identifiable Information. Any such identifying information will be used only for this purpose.
12. Minors
Our products and services are not intended for individuals under the age of majority in their province of residence, and we do not knowingly collect Personally Identifiable Information from such individuals. Individuals under the age of majority in their province of residence should not use our products and services and should not provide us with their Personally Identifiable Information.
